Teenager not compensated for car damage due to falling lamppost in Harold Hill

A teenager who had a lucky escape when a lamppost fell on her car in heavy winds has received more bad news after waiting four months to hear from the council’s insurance company.
Olivia Evans, 19, of Brentwood, will not be compensated by Havering Council, or their insurance company, and will have to fork out £1,000 to repair her car, or lose her no claims bonus.
Miss Evans, who continues to drive around with her dented door, was told that the falling lamppost was not the result of any wrong-doing by the council.
Miss Evans was parked on Dagnam Park Drive, Harold Hill, as she visited her boyfriend, when the February storm brought down the lamppost, which hit her passenger door – inches away from Miss Evans who was in the car.
Miss Evans’s concerned mother, Gaynor Evans, said: “I can’t tell you how angry I am that the council is refusing to take responsibility.”
Residents had reported the rusty lamppost as “out of kilter” to the council the day before, with the council sending out contractors who were unable to make repairs the same day.
Orders were put in to ensure work on the lamppost was to be completed as soon as possible.
Mrs Evans said: “Olivia is fuming. We’re quite disgusted with the way we have been treated. If she’d been parked the other way, she could’ve died – it’s incensed me so much.”
The council apologised for the delay but maintain that they carry out regular checks on street furniture.
Havering cabinet member Cllr Robert Benham said: “We understand that Miss Evans must be disappointed and frustrated, however, cases are always fully investigated. In this instance, the insurance provider found that the council took all reasonable steps and is not liable for the damage.
“Nothing more could have been done to avoid this incident happening.”
